Use of the platform
The Foundation for Innovation and Technology (FIT) is a foundation under private law, governed by its Articles of Association and Regulations.
FIT provides entrepreneurs free of charge with a platform on the fit-previsionnel.ch website (hereinafter the ‘Website’) enabling them to create funding dossiers (projects), share them with FIT and selected third parties and communicate with FIT.
In order to use the Website, the user must create a user account. The purpose of the Website is to share a project. If the account is not used for six months, FIT will send an e-mail to the account holder indicating that if the account is not used within 60 calendar days of the e-mail being sent, the project will be automatically deleted from the user account. A deleted project cannot be recovered.
FIT maintains its Website with particular attention to the quality, completeness and security of the information contained therein. In addition, FIT takes all reasonable steps to ensure the proper functioning of the Website. Nevertheless, FIT cannot guarantee the availability of the Website or the accuracy, reliability and completeness of the information, images, documents, software and other data contained therein. In addition, system failures such as interruptions, virus attacks or loss of data cannot be ruled out.
Finally, FIT reserves the right to add to, modify or delete the Website and the information published on it at any time and without prior notice.
Use of cookies
Cookies are used to improve the services provided to you. Some are essential to the operation of the site, while others are used to improve its performance and/or your user experience.
You can disable cookies in your browser preferences. Please note that if you do not authorise the storage of cookies, certain functions and pages will not behave correctly.
To delete a cookie from your computer, follow the instructions in your browser's online help.
Limitation of liability
To the extent permitted by Swiss law, FIT shall not be liable for any direct, indirect or consequential damages arising from the consultation, exploration, use or inability to use the Website.
Intellectual property rights
All elements of the Website are protected by intellectual property law, in particular copyright law. The reproduction, transmission, modification or use of the Website for public or commercial purposes, as well as the creation of links to the Website, are subject to the prior written authorisation of FIT.
Confidentiality, prohibition of competition
The members of the Foundation Board, the other bodies of the Foundation and its agents and employees are obliged to maintain secrecy towards third parties with regard to facts brought to their knowledge in the exercise of their duties. Any person involved in the selection, study or monitoring of a project undertakes not to divulge information relating to the project, nor to use it for his or her own benefit or for the benefit of a third party without the formal prior written agreement of the applicant or the company.
Data security
Despite the organisational and technical security measures put in place by FIT, it is impossible to guarantee zero risk with regard to the security of the Website and digital communications (e.g. via the Website or by e-mail). Cyber threats are constantly evolving and there is always a certain level of risk of data being accessed by an unauthorised third party inherent in the use of the Internet. We encourage you to take extra precautions to protect your data, such as creating strong passwords, regularly updating your software and adopting good secure browsing practices.
By using the Website and communicating with us through the Website or by email, you accept the inherent risks of cyber incidents and understand that we cannot be held responsible for any breaches of security, except in cases of gross negligence on our part.
If you become aware of any suspicious activity or if your password is compromised, you agree to promptly contact FIT.
Data protection
Accesses to pages on the Website are recorded for statistical purposes, resulting in feedback on statistical data. These statistics are collected completely anonymously.
When FIT receives personal information via its Website that also requires a personal response (such as questions or orders by e-mail), the corresponding personal data is not passed on for other purposes.
Right of access, rectification and deletion of personal data contained in the user area. Users have the right to access, rectify and delete personal data contained in their user space. The information transmitted by the user remains under his/her control. Subject to provisions to the contrary in these GCU or by law, the user may modify it or ask FIT to delete it. When the user chooses to delete his/her user account, the personal data contained in this account is deleted, with the exception of: user name, email address, surname, first name, connection traces [logs] to respond to any disputes and for statistical purposes. In all cases, this data is destroyed 10 years after the account is deleted.
If the funding application is presented to the FIT Selection Board, a copy of the application will be extracted and saved in its entirety (including all attachments).

Applicable law and place of jurisdiction
These general terms and conditions of use, as well as the use of the Website and, more generally, FIT's services, are governed by Swiss law. Any dispute shall be subject to the jurisdiction of the courts of the canton of Vaud.
