General Terms of Use

Use of the platform
The Foundation for Innovation and Technology (FIT) is a foundation under private law, governed by its statutes and regulations.
FIT makes available to entrepreneurs, free of charge, a platform on the website fit-previsionnel.ch (hereinafter the "Website") allowing them to create financing applications (projects), share them with FIT and selected third parties, and communicate with FIT.
In order to use the Website, the user must create a user account. The purpose of the Website is to share a project. If the account is not used for six months, FIT will send an email to the account holder informing them that if the account is not used within 60 calendar days from the date the email is sent, the project will be automatically deleted from the user account. A deleted project cannot be recovered.
FIT maintains its Website with particular attention to the quality, completeness and security of the information it contains. In addition, it takes all reasonably possible measures to ensure the proper functioning of the Website. Nevertheless, FIT cannot guarantee the availability of the Website or the accuracy, reliability and completeness of the information, images, documents, software and other data contained therein. Furthermore, system failures such as interruptions, virus attacks or data loss cannot be excluded.
Finally, FIT reserves the right to supplement, modify or delete the Website as well as the information published on it at any time and without prior notice.

Use of cookies
Cookies are used to improve the services provided to you. Some are essential for the functioning of the site, others serve to improve its performance and/or your user experience.
The recording of cookies can be disabled in your browser preferences. Note that if you do not allow the storage of cookies, certain features and pages will not behave correctly.
To delete a cookie present on your computer, follow the instructions in the online help of your internet browser.

Limitation of liability
Within the limits permitted by Swiss law, FIT cannot be held liable for direct, indirect or consequential damages resulting from the consultation, exploration, use or inability to use the Website.

Intellectual property
All elements of the Website are protected in particular by intellectual property legislation and especially by copyright law. Reproduction, transmission, modification or use for public or commercial purposes of the Website, as well as the creation of links to it, are subject to prior written authorization from FIT.

Confidentiality, non-compete
Members of the Foundation Council, the other bodies of the Foundation as well as its agents and employees are required to keep secret from third parties any facts brought to their attention in the exercise of their duties. Any person involved in the selection, review or follow-up of a project undertakes not to disclose information relating to the project, nor to use it for their own benefit or for the benefit of a third party without the prior formal written consent of the applicant or the company.

Data security
Despite the organizational and technical security measures put in place by FIT, it is impossible to guarantee zero risk regarding the security of the Website and digital communications (for example via the Website or by email). Cyber threats are constantly evolving and there is always a certain level of risk of access to data by an unauthorized third party inherent in the use of the Internet. We encourage you to take additional precautions to protect your data, such as creating strong passwords, regularly updating your software and adopting good secure browsing practices.
By using the Website and communicating with us through the Website or by email, you accept the inherent risks of cyber incidents and understand that we cannot be held liable for any security breaches, except in cases of gross negligence on our part.
If you notice suspicious activity or if your password is compromised, you undertake to contact FIT promptly.

Data protection
Accesses to the pages of the Website are recorded for statistical purposes, resulting in feedback regarding statistical data. These statistics are collected completely anonymously.
When FIT receives via its website personal information that also requires a personal response (such as questions or orders by email), the corresponding personal data are not transmitted for other purposes.
Right of access, rectification and deletion of personal data contained in the user area. The user has the right to access, rectify and delete personal data contained in their user area. Information transmitted by the user remains under their control. They may, subject to any contrary provisions of these Terms of Use or the law, modify it or request that FIT delete it. When the user chooses to delete their user account, the personal data contained in this account are deleted, with the exception of: username, email address, last name, first name, connection logs to respond to any disputes and for statistical purposes. They are in any case destroyed 10 years after the deletion of the account.
If the financing application is presented to the FIT Selection Council, a copy of this file will be extracted and saved in its entirety (including all attachments).

Applicable law and jurisdiction
These general terms of use, as well as the use of the Website and, more generally, the services of FIT, are governed by Swiss law. Any dispute shall be subject to the jurisdiction of the courts of the canton of Vaud.
